Jury Trial
Richard Kismer, the plaintiff, alleged that he had been an agent for Allstate Insurance Company and that Allstate Insurance Company had improperly denied him a renewal of his independent contractor agency agreement with Allstate Insurance Company. Plaintiff alleged that he was not terminated for the reasons set forth by Allstate, but rather was terminated in retaliation for reporting alleged improper claims practices. Allstate Insurance Company denied that they committed any improper claims practices and further asserted that the reasons set forth in his Notice of Termination were accurate.
The plaintiff claimed, as a result of the termination of his agency agreement, that he had sustained damages in excess of $2.5 million dollars.
Settlement After Five-Day Trial
After a five-day trial, the plaintiff capitulated and accepted the defendant’s pre-trial settlement offer. The plaintiff had claimed that his agency agreement with Allstate Insurance Co. had been terminated improperly. The plaintiff claimed that as a result of the termination of his agency agreement with Allstate Insurance Co., that he had sustained damages in excess of $2.5 million dollars. After a five-day trial, plaintiff capitulated and accepted the defendant’s pre-trial offer. |
