Plaintiff claimed low back injury and torn left medial meniscus from a rear-end motor vehicle accident. Plaintiff was standing in the bed of a pick-up truck parked on the shoulder of Interstate 70. Defendant admitted negligence. Plaintiff incurred medical bills of $7,007.94 of which $6,578.94 were incurred within 3 days of the accident and the remainder were incurred 2 years after the accident. Plaintiff’s counsel “recommended” a total verdict of $307,007.94 comprised of $7007.94 for past medical bills, $100,000 for past pain and suffering, $100,000 for loss of earnings and $100,000 for loss of normal life. (Plaintiff subsequently died from unrelated Lou Gerhigs Disease). The jury returned a verdict for $13,478.94: $6,578.94 in medical expense; $2,000 for loss of normal life; $1,950 for loss of earnings; and $2,950 for pain.
